Article 1 Purpose
The purpose of these Terms and Conditions is to stipulate the rights, obligations, responsibilities, and other necessary matters between Wellness Co., Ltd. (hereinafter referred to as the "Company") and users in connection with the use of services (mobile and internet-related services, hereinafter referred to as the "Services") provided on the experience application site operated by the Company (hereinafter referred to as the "Site"). These Terms shall also apply to electronic transactions conducted using mobile devices, insofar as they do not contradict their nature.
Article 2 Operation
These Services are operated by the Company and consist of applicants, doctors, and instructors who have agreed to these Terms and have been permitted to participate by the Company.
Article 3 (Specification, Effect, and Revision of Terms)
1. The Foundation shall post these Terms, including its trade name, business address (including an address for consumer complaints), representative’s name, business registration number, contact information (phone, fax, email, etc.), mail-order business registration number, and personal information manager, on the initial screen of the Site for easy access by users. However, the Terms may also be made viewable via linked screens.
2. The Foundation may revise these Terms to the extent that it does not violate relevant laws such as the “Act on Consumer Protection in Electronic Commerce,” the “Act on the Regulation of Terms and Conditions,” the “Framework Act on Electronic Documents and Transactions,” the “Electronic Financial Transactions Act,” the “Electronic Signature Act,” the “Act on Promotion of Information and Communications Network Utilization and Information Protection,” the “Door-to-Door Sales Act,” and the “Framework Act on Consumers.”
3. If the Foundation revises the Terms, the effective date and reasons for the revision shall be specified, and such revisions shall be announced at least 7 days before the effective date on the initial screen of the Site or via a linked page. However, if revisions are disadvantageous to the user, a notice period of at least 30 days shall be provided. In such cases, the Site shall clearly indicate the differences between the current and revised Terms for easy understanding.
4. Revisions to provisions regarding purchase contracts shall only apply to contracts entered into after the effective date of such revisions, while previously executed contracts shall remain subject to the original Terms. However, if a user wishes for revised Terms to apply to an existing contract, they may request such application during the notice period, subject to the Foundation’s consent.
5. If the Foundation notifies members of the revised Terms and clearly states that failure to express dissent within 30 days shall constitute consent, and the member does not explicitly object, the member shall be deemed to have agreed to the revised Terms. If a member does not agree, the revised Terms shall not apply, and the member may terminate the usage contract. However, if special circumstances prevent the application of the previous Terms, the Foundation may terminate the usage contract.
Article 4 (Matters Not Specified and Relation to Laws)
1. Matters not specified in these Terms shall be governed by relevant laws such as the “Act on Consumer Protection in Electronic Commerce” and general commercial practices.
2. In cases where purchases are made through the Foundation’s services, relevant laws such as the “Act on Consumer Protection in Electronic Commerce” shall prevail over these Terms, and users may not claim exemption from liability by citing these Terms.
3. The Foundation may establish specific terms (hereinafter referred to as “Individual Terms”) for particular services and notify users in advance via the Site. In cases of revisions to such Individual Terms, Articles 3(2) to 3(5) shall apply mutatis mutandis.
4. Where separate agreements, contracts, or notifications exist between the Foundation and a user, those agreements shall prevail over these Terms and any Individual Terms unless otherwise specified.
5. Users are responsible for monitoring changes to these Terms or Individual Terms and must review such changes when announced.
Article 5 (Types of Services)
1. The Foundation shall provide the following services:
1) Development and operation of the Foundation’s website, Yeongdeok Festival Portal, Yeongdeok Tourism Portal, and affiliated sites in partnership with the Yeongdeok Culture & Tourism Foundation
① Purchase-related support services
② Posting and search services for product information
③ Delivery of products for which purchase contracts have been made
④ Payment support services
⑤ Other e-commerce-related services
2) Marketing support services such as advertising and promotions
3) Other services established as necessary by the Foundation
4) Any other tasks determined by the Foundation
2. The services listed in Paragraph 1 allow users to make purchases via the Foundation’s Site. For goods sold directly by the Foundation, it assumes the responsibilities of an e-commerce business operator in accordance with relevant laws.
3. In cases of product shortages or technical specification changes, the Foundation may alter the content of products or services provided under future contracts. Such changes shall be immediately announced at the place where the original product or service information was posted.
4. If the Foundation changes the content of services under contract due to product shortages or technical specification changes, it shall immediately notify the user through pre-agreed contact methods (e.g., phone, email).
5. In such cases, the Foundation shall promptly refund any amounts paid by the user, except when the change is not attributable to the Foundation’s intent or negligence.
6. Where there are Individual Terms, notices, guides, or detailed product pages specifying additional service details, such Individual Terms shall prevail over these Terms, with unspecified matters governed by these Terms.
Article 6 (Service Period and Suspension)
1. The service period under these Terms begins on the day a user consents to these Terms and continues until the user’s withdrawal (termination) request is processed and all rights and obligations have ended.
2. The Foundation may temporarily suspend Services in cases of system maintenance, replacement, breakdowns, or communication failures.
3. In such cases of suspension, the Foundation shall notify users as provided in Article 12.
4. In cases of force majeure such as natural disasters, the Foundation may restrict or temporarily suspend the Services.
5. The Foundation may temporarily or permanently modify or discontinue all or part of the Services for reasons such as business transition or discontinuation.
Article 7 (Service Fees)
The Foundation may provide various services necessary for free e-commerce transactions between users and may impose fees (service fees) for such services in accordance with its internal policies.
Article 8 (Membership Registration)
1. A user may apply for membership by filling out the membership form specified by the Foundation and expressing agreement with these Terms.
2. The Foundation shall register users as general members unless they fall under the following cases:
1) Applicants who previously lost membership status under Article 11(7).
However, exceptions may be made if 3 years have passed and the Foundation consents to re-registration.
2) Cases of false, omitted, or incorrect registration information.
3) Cases where registration as a general member is deemed to significantly hinder the Foundation’s technical operations.
3. The membership contract is established when the Foundation’s approval reaches the user.
4. Members must notify the Foundation of any changes to their registration information within a reasonable time by editing their membership details. The Foundation is not liable for any disadvantages caused by failure to update such information.
5. The Foundation may allow or restrict purchases or use of services by non-members. If allowed, these Terms shall apply unless otherwise specified, but services premised on membership may be excluded. Non-members cannot contest restrictions on purchases or service use.
Article 9 (Withdrawal and Termination of Membership)
1. Members may request withdrawal at any time, provided that all transactions have been duly completed.
2. The Foundation shall process membership withdrawals immediately upon request, except where outstanding obligations remain, in which case personal data may be retained for debt collection purposes or as required by law.
3. Members are responsible for any disadvantages arising from failure to properly complete withdrawal procedures.
4. Upon withdrawal, the Foundation may revoke any additional benefits previously granted, and members may not demand reinstatement of such benefits upon rejoining.
5. Members may reapply for membership under Article 8 if they wish to use the Services again after withdrawal.
6. The Foundation may restrict or suspend membership in the following cases:
1) False information provided during registration.
2) Unjustified refusal to accept purchased goods or services.
3) Interference with other users’ service usage or misappropriation of information.
4) Illegal or prohibited activities contrary to these Terms or public order.
5) Acts that disrupt the Foundation’s operations, such as spreading false information, abusive behavior toward staff, repeated unjustified complaints, habitual returns without defects, mass order cancellations, fraudulent accumulation of points, or misuse of coupons.
7. If prohibited behavior continues after restriction or suspension, or is not corrected within 30 days, the Foundation may terminate membership.
8. In cases of membership termination, the Foundation shall delete the member’s registration and notify them, granting at least 30 days to provide explanations before final termination.
Article 10 (Notices to Users)
1. Notices may be sent via pre-agreed methods such as text messages, KakaoTalk alerts, or email.
2. General notices to unspecified users may be substituted by posting on the Site for at least one week. However, matters significantly affecting an individual user’s transactions shall be communicated individually.
Article 11 (Member’s Personal Information)
1. In accordance with the “Act on Promotion of Information and Communications Network Utilization and Information Protection (2016.7.25),” the Foundation collects essential personal information during membership registration: ID, password, nickname, email, date of birth, and verification details.
2. Real-name verification for names and dates of birth is entrusted to NICE Information Service Co., Ltd., and personal data is handled in accordance with the “Act on Promotion of Information and Communications Network Utilization and Information Protection.”
Article 12 (Obligations of Members)
1. Members shall not engage in the following:
1) Providing false information during registration or updates
2) Infringing on the Foundation’s or third parties’ intellectual property rights
3) Misusing another member’s ID
4) Posting or transmitting prohibited information under relevant laws
5) Impersonating staff or others
6) Distributing viruses or malicious code
7) Stalking or harassing other members
8) Collecting or disclosing others’ personal information without consent
9) Posting advertisements or obscene material
10) Violating service notices or rules
2. Violators may have membership restricted, suspended, or revoked in accordance with Article 6(2) and (3).
3. Members shall be liable for damages caused to the Foundation or others due to their actions.
Article 13 (Deletion of Public Posts)
1. The Foundation may delete public posts without prior notice and restrict or revoke membership if posts:
1) Defame others
2) Violate public morals
3) Relate to criminal activity
4) Infringe copyrights or other rights
5) Violate laws
6) Cause religious or political disputes interfering with operations
2. If a third party takes legal action (e.g., complaint, injunction, lawsuit) against a user or the Foundation regarding a post, access to the post may be temporarily restricted until resolution.
3. Under the “Information and Communications Network Act,” if a post violates privacy or defames an individual, the affected party may request deletion, and the Foundation may restrict access for up to 30 days pending resolution.
4. Users whose posts are temporarily restricted may request restoration. If restoration is requested, the restriction is lifted unless legal authorities (e.g., courts, KCSC) confirm a violation, in which case the post is deleted. If no request is made, the post is permanently deleted after the temporary restriction period.
Article 14 (Copyrights and Use of Posts)
1. Copyright and intellectual property rights for works created by the Foundation belong to the Foundation.
2. Members may not reproduce, distribute, or use service-provided information for commercial purposes without prior approval.
3. Copyright of member-created posts belongs to the posting member, but the Foundation may use such posts within reasonable scope for operation, exhibition, transmission, distribution, or promotion without separate approval. This includes:
1) Reproduction, modification, adaptation, exhibition, and distribution within the service
2) Provision to media or partners for promotion (excluding personal data beyond user IDs)
3) Other uses require prior consent via phone, fax, or email
4) Upon membership termination, stored content under the member’s ID shall be deleted
Article 15 (Purchase Applications)
1. Members may apply to purchase the Foundation’s products or services through its Site or systems using the following or similar methods, and the Foundation shall process such purchase applications as follows…

1) Select product or service
2) Enter the recipient’s name, address, phone number, email, etc.
3) Confirm details of the Terms and Conditions, services with restricted withdrawal rights, and associated fees
4) Express agreement with these Terms or refusal thereof (e.g., by clicking “I agree”)
5) Confirm purchase application and consent to allow the Foundation to verify information
6) Choose and confirm payment method
2. If the Foundation requires the provision of a buyer’s personal information to fulfill an order, it shall obtain the buyer’s consent and bear responsibility for data management in accordance with relevant laws.
Article 16 (Formation of Contract)
1. The Foundation may decline or defer acceptance of a purchase application in the following cases:
1) False, omitted, or erroneous information was submitted
2) Minors attempt to purchase goods or services prohibited by law without parental consent
3) Acceptance is deemed to significantly hinder the Foundation’s technical operations
2. A contract is deemed concluded when the Foundation’s acceptance notice reaches the member in the form specified in Article 17(1).
Article 17 (Notification of Acceptance and Modification/Cancellation of Applications)
1. The Foundation shall send an acceptance notice to the member when a purchase application is received.
2. Upon receiving the acceptance notice, the member shall review it and may request modification or cancellation immediately if there are discrepancies. If such a request is made before delivery, the Foundation shall process it without delay.
Article 18 (Payment Methods)
1. Payment for products or services purchased through the Foundation may be made using one of the following methods:
1) Credit card
2) Bank transfer
3) Real-time account transfer
4) Mobile payment
5) Gift certificates or vouchers approved by the Foundation
6) Other electronic payment methods provided by the Foundation
2. The Foundation shall not impose additional fees on the payment method selected by the member beyond those officially charged by payment processors.
Article 19 (Supply of Goods and Services)
1. Unless otherwise agreed, the Foundation shall take necessary measures such as order processing, packaging, and delivery to supply the goods or services within 7 days from the member’s purchase application.
2. If delivery is delayed due to the Foundation’s fault, it shall compensate the member for any damages, unless caused by force majeure or reasons beyond its control.
Article 20 (Refunds, Returns, and Cancellations)
1. Members may request a refund, return, or cancellation in accordance with relevant laws such as the “Act on Consumer Protection in Electronic Commerce.”
2. If products are found to be out of stock or unavailable, the Foundation shall notify the member without delay and refund the amount received within 3 business days, or take necessary measures to ensure a prompt refund.
Article 21 (Withdrawal of Subscription)
1. Members may withdraw from a purchase contract within 7 days of receiving the acceptance notice or the goods, unless otherwise provided by law.
2. Members may not withdraw in cases where goods have been used, altered, or damaged in a manner that significantly reduces resale value, or in other cases prescribed by law.
3. Where withdrawal is restricted, the Foundation shall clearly indicate such restrictions in advance. If not indicated, members may withdraw without restriction.
4. In case of withdrawal, the Foundation shall promptly refund payments received and, if payment was made by credit card or electronic payment, take measures to cancel the charge.
Article 22 (Effects of Withdrawal)
1. In cases of lawful withdrawal, the Foundation shall refund payments within 3 business days of receiving returned goods.
2. The Foundation shall also cancel related charges with payment providers (e.g., credit card companies).
3. Members shall bear the cost of returning goods unless the withdrawal is due to the Foundation’s fault (e.g., defective or incorrect products).
Article 23 (Responsibilities of the Foundation)
1. The Foundation shall not engage in activities prohibited by law or these Terms and shall strive to provide stable services in accordance with these Terms.
2. The Foundation shall establish a security system to protect users’ personal information, including credit information, for safe internet use.
3. The Foundation shall not send advertising emails or communications against the recipient’s will.
Article 24 (Responsibilities of Members)
Members shall not use the Services in a way that disrupts public order or infringes on the rights of others, and shall comply with obligations under these Terms and relevant laws.
Article 25 (Dispute Resolution)
1. The Foundation shall establish and operate a customer service center to handle users’ legitimate complaints and damage claims.
2. Disputes between the Foundation and users may be resolved through mediation by the Fair Trade Commission or dispute mediation institutions designated by law.
Article 26 (Jurisdiction and Governing Law)
1. Lawsuits regarding e-commerce disputes between the Foundation and users shall be subject to the competent court under the Civil Procedure Act.
2. These Terms and disputes shall be governed by the laws of the Republic of Korea.
Article 27 (Member’s Obligations Regarding ID and Password)
1. Except as provided in Article 26, the responsibility for managing the member’s ID and password lies with the member.
2. Members shall not transfer, lend, or otherwise allow third parties to use their ID or password.
3. The member shall bear responsibility for any losses or damages resulting from the leakage, transfer, or lending of their ID or password, unless due to the Foundation’s fault.
4. If a member becomes aware that their ID or password has been stolen or used by a third party, they shall immediately notify the Foundation and comply with any instructions provided by the Foundation.
Article 28 (User’s Obligations)
Users shall not engage in the following acts:
1) Registering false information when providing or modifying personal details
2) Collecting or stealing another person’s personal or payment information
3) Altering information posted on the Foundation’s Site
4) Transmitting or posting information (e.g., computer programs) not designated by the Foundation
5) Infringing upon the intellectual property rights of the Foundation or third parties
6) Defaming or interfering with the business of the Foundation or third parties
7) Disclosing or posting obscene, violent, or otherwise immoral information (text, images, audio, etc.) on the Foundation’s Site or stores
8) Transferring or selling rights or obligations arising under these Terms to others without the Foundation’s prior consent
9) Any other acts that violate applicable laws or the Foundation’s service policies
Article 29 (Intellectual Property Rights and Restrictions on Use)
1. Copyrights and other intellectual property rights in works created by the Foundation belong to the Foundation.
2. Users shall not reproduce, transmit, publish, distribute, broadcast, or otherwise use for commercial purposes, or allow third parties to use, information to which the Foundation owns intellectual property rights without the Foundation’s prior consent.
3. Copyright and all responsibility for posts created by members (e.g., product reviews, questions) belong to the members. However, the Foundation is granted a license (non-exclusive, royalty-free, unlimited in time and territory) to store, reproduce, modify, publicly transmit, display, distribute, and create derivative works of such posts for purposes including service provision, exposure on affiliated online stores, promotion of e-commerce services, service operation, improvement, new service development, product information management, and product marketing.
4. The Foundation may, without prior notice, delete posts or take measures in accordance with relevant laws or its policies if the posts fall under any of the following cases, and shall bear no responsibility:
1) Content that violates applicable laws
2) Posting or advertising illegal products or obscene material prohibited by law
3) Content containing false or exaggerated advertising
4) Content that infringes on others’ rights, reputation, credit, or legitimate interests
5) Content inducing direct transactions or posting links to other sites
6) Content containing malware or data that may cause device malfunctions
7) Content contrary to public order or morals
8) Content related to criminal acts
9) Content that may cause political or economic disputes
10) Content deemed to interfere with the smooth operation of the Foundation’s services
5. The Foundation may establish separate detailed usage guidelines for posts for each service, and members shall post content (including messages between members) in accordance with such guidelines.
Article 30 (Dispute Resolution)
1. In principle, disputes arising from transactions through the Foundation shall be resolved autonomously between users.
2. Exceptionally, the Foundation may intervene in disputes between itself and users, between users, or between users and third parties, to facilitate fair and smooth resolution.
3. Users shall respect the Foundation’s decisions in good faith to the greatest extent possible.
4. If disputes cannot be resolved through the Foundation, users may apply for dispute mediation to agencies such as the Fair Trade Commission or dispute resolution bodies commissioned by provincial governors, and the responsible party shall comply with such mediation.
Article 31 (Disclaimer of the Foundation)
1. Responsibility for disputes arising from transactions using the Site’s trading system lies with the parties involved in the transaction.
2. The Foundation shall not be liable for users’ failure to achieve expected profits through the Site or Services, or for damages arising from the use of materials obtained through the Site or Services.
3. Users bear sole responsibility for the credibility and accuracy of information, data, or facts posted, and the Foundation assumes no responsibility for damages caused to users or third parties due to inaccurate or false content.
4. The Foundation shall not be liable for damages to users or third parties caused by intentional or negligent acts of the users themselves in connection with the use of the Site or Services.
5. If services are temporarily suspended for reasons under Article 6(2), the Foundation shall not be responsible for damages suffered by members or third parties, except in cases of intentional misconduct or gross negligence by the Foundation.
6. If services are restricted or suspended for reasons under Article 6(5), the Foundation shall be exempt from liability due to force majeure.
7. The Foundation bears no responsibility for damages arising from users disclosing or providing their personal information to others.
8. Transactions conducted via mobile services may not be processed in real time and may be restricted or delayed due to the user’s location or the wireless data service provider’s circumstances.
Article 32 (Jurisdiction and Governing Law)
1. Lawsuits concerning electronic transactions and consumer disputes between the Foundation and users shall be filed with the competent court under the Civil Procedure Act.
2. The laws of the Republic of Korea shall apply to electronic transaction and consumer dispute lawsuits between the Foundation and users.
